Terms of Service

By engaging my services you are agreeing to the following terms of service.

1. DEFINITIONS

  1. Artist – Amras (@Amras.me on BlueSky, https://www.amras.me).
  2. Client – Person or Persons—all of whom must be at least 18 years of age or older and legally able to enter into a binding, legal contract within their country of residence—party to the Contract for Artistic Services (“Contract”) and this Terms of Service Agreement. Specified by the signature line of the Contract.
  3. Third Party – Any person or persons NOT subject to the Contract and this Terms of Service Agreement.
  4. Artwork – The final, finished, and completed work of art made for hire by Artist for Client subject to this Terms of Service Agreement.
  5. Project – Any collection or group of Artwork, to include any and all Sketches, WIPs, ALTS, and IP generated as a part of the production of Artwork.
  6. Sketch – Any rough drawing or in-progress work created in the process of the commission process subject to this Terms of Service Agreement.
  7. Private Commission – Any Project that will not be shared by Artist on their official artwork profile(s) [§2.6] as per an agreement with Client.
  8. Major Edit – Any edit to Artwork requiring 15% or more of total effort/time to incorporate into the Artwork. Examples include, but are not limited to:
    1. Repositioning of a character’s body or limbs requiring redrawing.
    2. Addition of large character features (antlers, wings, permanent accessories, etc.) which are not listed on any reference or description provided to Artist by Client at hire.
  9. Minor Edit – Any edit to Artwork requiring less than 15% total effort/time to incorporate into the Artwork.
  10. Transfer – The resale, gifting, or trade of Artwork to any Third Party.
  11. ALT – Additional or “alternate” versions of Artwork. Examples of ALTs include, but are not limited to:
    1. SFW variations
    2. different facial expressions
    3. multiple/alternate outfits
    4. addition of or removal of genitals
    5. NSFW variations.
  12. NSFW – Not Safe For Work
  13. WIP – Work In Progress
  14. NFT – Non-Fungible Token
  15. IP – Intellectual Property

2. GENERAL

  1. Artist RETAINS ALL COPYRIGHT to the artwork unless the individual Project IP is purchased by the Client (available for an additional fee).
    • Client may re-upload Artwork (to their personal social media accounts) as long as Artwork retains Artist signature AND the post contains a link to the original, Artist upload.
  1. Artist reserves the right to decline any Client and/or Project for any reason with or without notice.
  2. Artist will, to the best of their ability, complete Projects within a one (1) to three (3) calendar month timeline.
    • Artist will, to the best of their ability, maintain communication with Client and keep Client apprised of any and all updates and/or delays to the Project.
    • Please allow two (2) weeks minimum from hire before asking for additional update(s).
  1. Artwork is NOT to be altered under ANY circumstances with exception for the following:
    1. Artwork may be made into Telegram “Stickers” by Client.
    2. Any Telegram “Sticker Pack” featuring ANY Artwork by Artist must include a credit sticker within the pack naming Artist. For ease of use, Artist has provided one for Client use here.
  2. Artwork will be uploaded by Artist to one or more of the following sites:
  3. All other details, stipulations, and legal terms and conditions are contained in the Contract for Artistic Services. Artist has made a general copy of the Contract available for review prior to hire engagement here.

3. ORDERING & PAYMENT

  1. All pricing for services offered by Artist are listed and accessible here.
  • CLIENT MUST BE 18 YEARS OF AGE OR OLDER AND LEGALLY ABLE TO ENTER INTO A CONTRACT IN THEIR OWN NAME WITHIN THEIR LOCATION OF RESIDENCE.
  • PROJECT IS “ACTIVE” OR “HIRED” ONLY ONCE THE CONTRACT HAS BEEN COMPLETED AND RETURNED TO ARTIST AND PAYMENT HAS BEEN RECEIVED.
    1. CONTRACTS WILL ONLY BE COMPLETED VIA ADOBE® SECURE SIGNATURE SERVICE THROUGH ADOBE® ACROBAT.
      • No subscription is necessary for Client to utilise this service.
      • Client MUST supply Artist with a VALID email address prior to Contract being sent for completion.
  • ARTIST ACCEPTS PAYMENTS VIA SQUARE’S CASH APP AND PAYPAL ONLY.
  • NO REFUNDS, EXCEPT IN THE FOLLOWING EXTRAORDINARY CIRCUMSTANCES:
    1. WIPs will be provided to Client during the following stages of a project:
      1. Additional WIPs may be provided, but are not guaranteed.
      2. Minor fixes may be requested by Client to correct any accidental omissions or errors.
  • Once sketch(es) are approved by Client, only two (2) Major Edits are provided as part of the process.
    1. Client may request an ALT of Artwork at any time.
      • ALTs will incur an additional fee on a sliding scale of $15 – $50 per instance.
    2. Artwork will be sent to Client as a high-resolution PNG file via DropBox.

4. COMMERCIAL USE

  1. Commissions CAN be included in the Transfer of any character they were drawn for.

 

Contract

Amras utilises a contract for all commissions. In order to commission him, you must read, agree to, sign, and return the contract. This is for his legal protection as much as it is yours. Amras understands that this is not how the MAJORITY of furry artists conduct business, but as a professional artist he understands the ramifications of conducting business without "covering your bases" and is unwilling to take unreasonable risks.
